L&#8217;art est d\u00e9cid\u00e9ment une source d&#8217;inspiration qui semble sans fin. Cette manne a-t-elle des limites\u00a0?<\/p>\n<p>&nbsp;<\/p>\n<h2>Pourquoi imiter les artistes\u00a0?<\/h2>\n<p>Tout le monde est capable d&#8217;identifier Mona Lisa. M\u00eame si tous ne se rappellent pas son histoire, ni le nom du peintre, ce tableau est c\u00e9l\u00e8bre dans le monde entier. Il doit d&#8217;ailleurs \u00eatre l&#8217;un de ceux qui a \u00e9t\u00e9 le plus revu et corrig\u00e9 au fil du temps. On a vu cette dame en <a href=\"https:\/\/www.lexpress.fr\/insolite\/en-images-la-joconde-et-autres-celebres-tableaux-en-version-tatouee_1762425.html\">version tatou\u00e9e<\/a>, avec des moustaches et dans bien d&#8217;autres configurations\u00a0. De nombreux artistes, tous genres confondus, ont ainsi pris rendez-vous avec la myst\u00e9rieuse matrone, que ce soit pour le plaisir de l&#8217;art ou celui de la publicit\u00e9.<\/p>\n<p>Si ce tableau, comme d&#8217;autres, est aussi souvent revisit\u00e9, c&#8217;est parce qu&#8217;il cr\u00e9e une connivence avec la personne qui le regarde. Il s&#8217;adresse directement \u00e0 lui, en lui signalant\u00a0:<\/p>\n<ul>\n<li>qu&#8217;il a de la culture, puisqu&#8217;il reconna\u00eet l&#8217;\u0153uvre originelle\u00a0;<\/li>\n<li>qu&#8217;il partage des r\u00e9f\u00e9rences communes avec celui qui lui pr\u00e9sente le d\u00e9tournement.<\/li>\n<\/ul>\n<p>Il s&#8217;agit d&#8217;ailleurs d&#8217;une v\u00e9ritable strat\u00e9gie marketing\u00a0: l&#8217;art permet d&#8217;initier un double lien. Avec le client, bien s\u00fbr, mais aussi avec l&#8217;art, \u00e0 la mani\u00e8re d&#8217;une caution culturelle.<\/p>\n<p>&nbsp;<\/p>\n<h2>Qui a le droit&#8230; d&#8217;imiter l&#8217;art\u00a0?<\/h2>\n<p>Si l&#8217;on observe bien les \u0153uvres qui sont transform\u00e9es \u00e0 des fins publicitaires, souvent pour des affiches, il s&#8217;agit majoritairement de tableaux anciens. Voire tr\u00e8s ancien. Ce choix repose pourtant plus sur la c\u00e9l\u00e9brit\u00e9 de l&#8217;\u0153uvre, qui a eu le temps d&#8217;acqu\u00e9rir ses lettres de noblesse, que sur une r\u00e9flexion juridique.<\/p>\n<p>En effet, m\u00eame si les droits patrimoniaux sont tomb\u00e9s dans le domaine public, ce n&#8217;est pas n\u00e9cessairement le cas des droits moraux. Ces derniers peuvent \u00eatre exerc\u00e9s tant que l&#8217;\u0153uvre existe et il convient donc de demander une autorisation \u00e0 leur titulaire avant toute utilisation de celle-ci. Il peut cependant \u00eatre parfois difficile de les identifier et, a fortiori, d&#8217;obtenir leur aval pour une utilisation sur un visuel.<\/p>\n<p>Pour s&#8217;affranchir de cette limite, il reste possible d&#8217;opter pour un pastiche, une caricature ou une parodie. Selon l&#8217;article L.122-5 du Code de la <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/id\/LEGIARTI000006278917\/2008-12-11\/\" target=\"_blank\" rel=\"noopener noreferrer\">propri\u00e9t\u00e9 intellectuelle<\/a>, aucun ayant-droit ne peut s&#8217;opposer \u00e0 ce type de reprise. Cette loi explique sans doute les nombreuses versions humoristiques de certains tableaux. Il faut cependant rester prudent quant \u00e0 l&#8217;utilisation de ces options, qui restent sujettes \u00e0 interpr\u00e9tation.<\/p>\n<p>&nbsp;<\/p>\n<h2>Diff\u00e9rentes mani\u00e8res de transformer une \u0153uvre<\/h2>\n<p>Contempler le travail effectu\u00e9 par de nombreux publicitaires peut \u00eatre une source d&#8217;inspiration. Tous sont autant de clins d&#8217;\u0153il aux \u0153uvres d&#8217;art originales. Voici les principales tendances qui se sont affich\u00e9es ces derni\u00e8res ann\u00e9es\u00a0:<\/p>\n<ul>\n<li>l&#8217;ajout d&#8217;accessoires sur <a href=\"https:\/\/www.arretsurimages.net\/media\/breve\/s171\/id17057\/original.69144.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">l&#8217;image principale<\/a><\/li>\n<li>la <a href=\"https:\/\/img.e-marketing.fr\/Images\/Breves\/TribuneExpert\/550\/image\/dejeunerherbedior.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">mise en sc\u00e8ne photographique<\/a>, mais plus moderne<\/li>\n<li>la <a href=\"https:\/\/www.arretsurimages.net\/media\/breve\/s171\/id17057\/original.69144.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">mosa\u00efque<\/a> (version petites briques de jeu, ou avec de nombreuses images coll\u00e9es les unes aux autres)<\/li>\n<li>la <a href=\"https:\/\/www.vivelapub.fr\/wp-content\/uploads\/miniatures\/popart.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">colorisation<\/a> pour mettre en \u00e9vidence certains aspects<\/li>\n<li>la \u00ab\u00a0<a href=\"https:\/\/img0.gtsstatic.com\/article\/insolite\/une-publicite-pour-un-mixer-inspiree-de-magritte_8e38f90bedd4c6dff5d60e8c5128e4c36edc428c.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">copie<\/a>\u00a0\u00bb presque parfaite mais r\u00e9alis\u00e9e avec d&#8217;<a href=\"https:\/\/i.pinimg.com\/originals\/57\/a7\/40\/57a74095e73587e766e0a02c461a0458.jpg\" target=\"_blank\" rel=\"noopener noreferrer\">autres techniques<\/a><\/li>\n<\/ul>\n<p>Il existe donc de nombreuses mani\u00e8res de rendre hommage aux artistes qui ont marqu\u00e9 l&#8217;Histoire.
